Gazumping ban won't end bad bahaviour in the property market

Towards the end of 2017, Secretary of State for Communities and Local Government Sajid Javid announced plans to make buying and selling homes ‘cheaper, faster and less stressful’.

Amongst his proposals was to clamp down on ‘gazumping’ which sees a buyer lose out on a property at the last minute after a higher offer is received.

Here, Jonathan Williams, partner specialising in property law at Roythornes Solicitors, explains why putting a stop to gazumping will not prevent bad buyer and seller behaviour.

Government proposals aimed at outlawing gazumping – the practice whereby potential purchasers outbid other people who have already made an offer –  will not prevent bad behaviour by house sellers and buyers.

The real issue when purchasing and selling a home is not the cost of legal fees when sales fall through, but the current shortage of housing and people’s general lack of understanding of how the conveyancing system works.

According to latest statistics 200,000 transactions collapse each year, leaving would-be buyers with bills for surveys and legal fees to pay on the dream homes they have lost. Yes, it’s true that people do sometimes lose money during the selling and buying process, but it’s only a small problem when we consider the much bigger picture – in over thirty years as a conveyancing solicitor I have not seen a huge amount of abortive transactions.

We need to remember that people move house for all sorts of reasons – some planned, some not. A seller’s first port of call is an estate agent, not a solicitor, so invariably the house will not be ‘oven ready’ when it goes on the market.

Anyone can set themselves up as an estate agent.  Unless the seller has appointed qualified surveyors or land agents, there is always a chance that the estate agent will not have noticed defects in the title deeds or the absence of essential paperwork needed to make a successful sale.

Conveyancing transactions are not just plagued by a lack of preparation, but also by offers taken from people who do not have the means to buy. Until a mortgage offer is issued there is bound to be uncertainty.

A chain only moves at the pace of its slowest link. It’s like joining a train heading for one destination; people board at different stations, all to arrive at the same time.  But with conveyancing some people might lose patience with the process, get tripped up or be unable to raise a mortgage, so they will get off the train early.

It is said that Scotland’s system of sealed bids promotes early commitment but I suspect this also means that any issues are discovered later, with parties then left to look for reasons to back out. At least our system, although not perfect, allows us to address any problems first and then commit.

The Council of Mortgage Lenders’ handbook runs to many pages, and includes the basic requirements for every mortgage, plus the individual points lawyers must satisfy before a home loan can be completed.  Conveyancing has become more onerous and time consuming, with the risk management required for lawyers, buyers, sellers and mortgagees adding further expense.

In my view it’s not worth the Government banning gazumping to try and fix a system which although not ideal is not broken either. The fact is that moving home and getting the best price for our properties are highly emotive issues, and will remain so regardless of the rules around one annoying practice. Why not instead educate potential buyers and sellers on better preparation and seeking good and informed counsel.

‘Fundamental shift’ in home owner behaviour means the big opportunity for agents now lies in lettings, claim

The reason for residential property transactions’ failure to recover to pre-credit crunch levels is down to a “fundamental shift” in home owner behaviour.

And it’s a shift that makes lettings, rather than sales, the major opportunity of the future for agents.

That’s the claim made by Jefferies analyst Anthony Codling during a presentation at the Guild of Property Professionals conference in London last week.

He said: “Transactions almost halved in the credit crunch.

“House prices fell 20% but then started to go back up again.

“Transactions remained significantly below where they were before.

“There’s a simple reason as to why: in my view, there is a fundamental shift in the way home owners behave and I believe it is driven by the age of home owners.”

EYE recently reported that residential transactions in England and Wales fell by nearly 15% last year, according to Land Registry figures.

The latest Price Paid Data from the Land Registry, which details property submitted for registration in December, suggests there were 70,943 residential sales registered in the last month of the year.

This is down from 99,385 in November and takes the total registrations for 2017 for residential property to 850,281.

The number of transactions in 2017 is far fewer than the 1.2m annual sales regularly reported in recent years and well below the 2m transactions a year that were a feature of the housing market in the 1980s.

Meanwhile, English Housing Survey figures show that home ownership has been in decline, peaking at around 71%, falling to 63% now.

Over the same period, the private rented sector has grown from around one in ten people in 1980 to in five last year.

Codling said: “It is easy for me to say because I am an analyst, but I see the private rented sector as the huge opportunity for agents, despite all that we have been learning about tenant fee bans and GDPR and so on.

“It might be a less profitable sector but a much bigger sector in the years to come.

“We saw huge growth in homes from the end of the Second World War, and it wasn’t until 1971 that half the people in the UK were home owners, so home ownership in the UK in the context of history is still a relatively new phenomenon.”

His views were echoed by David Smith in the Sunday Times yesterday.

Examining, among other data, the English Housing Survey, Smith said: “The German model of later home ownership is becoming the norm in Britain.

“The fall in owner-occupation among the 25-34 age group, from 57% to 37%, alongside an increase from 27% to 46% in private renting, is just as stark.”

He continued: “After shrugging off the effects of the crisis, housing activity should be powering ahead and returning to some kind of normality.

“The fact that it is at best flatlining, at worst in a new decline, is worrying.”

Purplebricks faces calls to provide more data, as shares slip 15% in two days

Purplebricks is continuing to face calls to release more information about how many houses it sells, following a bruising end to last week which saw its share price slide 15% in just two days.

The company’s share price starts trading at 418.6p this morning after dropping from 489.8p on Wednesday — a fall of 14.5%.

The slide came after the publication of a bombshell report which claimed that the agent sells just over half of the properties it lists, rather than the 78% it has previously laid claim to.

The news made national headlines and at one point was the third most-read story on the BBC News website.

Purplebricks came out fighting, with UK CEO Lee Wainwright declaring the analysis “wrong”.

The controversy sparked a slew of comment on Purplebricks and its business model in the mainstream media.

The Financial Times Lex column said it was time for Purplebricks to start sharing its data about its sales completions.

It said: “House sale figures are recorded in UK government data.

“So why is Purplebricks so coy about its own? In the face of repeated questions over the number of completions the digital estate agent has enabled, it remains tight lipped. It should heed calls to publish the data.

“This is not to satisfy nosy rivals jealous of its ballooning market value, but to protect that value from erosion.

“Purplebricks is in the midst of a £50m expansion into the US. It will struggle to transpose its model if it is debunked.”

The FT article went on to say that there was much to like about Purplebricks but that it was too well established to lean on its Trustpilot reviews (the company announced last year that it would also add Feefo to its site).

It added: “There are two questions the agency should answer. One is the volume and speed of sale completions.

“Next is what it regards as ‘completed obligations’. If it suffices to post a house online without ensuring it sells, customers might think twice about paying a £1,100 fixed fee.”

Investment website the Motley Fool saw a possibility that the recent falls in Purplebricks’ share price was “overly defensive”.

But Paul Summers warned readers: “With so much uncertainty over whose figures are more accurate, I’d be tempted to look for other, less risky, holdings for a growth-focused portfolio at the current time.”

Meanwhile, Sky News presenter Ian King said in his analysis of the row between Codling and the hybrid agent: “Purplebricks will argue that none of those established players publish a figure for the number of homes that they sell, as a proportion of the properties they market, either. But those businesses do not charge customers an upfront fee and so it is not as relevant for them.

“The row is doubly damaging for Purplebricks because it is the latest in a string of rows over the way it does business.”

NatWest announce cuts to residential and BTL rates

Moving home costs UK £9.7bn in 2017

The latest research from removal company comparison website, Compare My Move, has revealed that UK homeowners spent £9,746,745,840 on moving house in 2017, with the average UK homeowner facing £9,580 in additional moving costs.

The figure takes into account a range of extra costs accrued when buying and selling a house, including conveyancing, surveying and estate agent fees, stamp duty, removal costs and fixed fees such as an Energy Performance Certificate.

Compare My Move's data revealed the hidden extra costs for homeowners and first time buyers alike, and highlight how the recent changes in Stamp Duty threshold affected first time buyers in 2017.

According to the findings, London is the most expensive region to move house in 2017, costing existing homeowners an eyewatering £28,714 in extra costs with first time buyers bearing the brunt of £7,765 in extra costs.

At the other end of the scale, The North East stands as the cheapest region to move house, costing home owners £5,058 on average. The research finds that first time buyers in North East and Scotland haven't seen any benefit from the new Stamp Duty threshold.

Not all moves are made equal

Of course, not all moves are made equal, and the costs of moving house varied region-by-region in 2017. The average cost of buying and selling a property in London tops the regions, costing existing homeowners a massive £28,714 in extra costs in 2017. As a comparison, the average homeowner in England spent £10,465 to move house last year.

The average moving costs in Scotland and Wales were less, but still daunting at an extra £6,032 and £6,246 respectively. The cheapest area to move house in 2017 was North East England, with house owners spending an extra £5,058 to move house.

First time buyers win and lose

With the recent slashing of Stamp Duty for first time buyers, the extra costs for moving into a first house has generally been levelled across the UK. The exception is London, where the average cost of a first house is higher than the £300,000 Stamp Duty threshold, meaning a substantial £7,765 bill for movers in 2017.

With the Stamp Duty changes, many first time buyers were in a better position at the end of 2017 than the start of last year. But even after including the changes, UK first time buyers had to pay on average £1,561 in extra costs to move in 2017. The cheapest region for first time buyers in 2017 was Scotland, with the cost of moving at £1,331 in 2017.

Scotland and North East England however saw no changes to the cost of moving house on account of the Stamp Duty changes, because of the low prices of houses for first time buyers in the area (moving costs remained at £1,331 and £1,531 respectively). In contrast, the North West saw a £1,636 reduction in costs because of Stamp Duty changes, bringing the moving costs level with the North East at £1,531.

Landlords confident of coping with rate rises

According to Paragon’s latest PRS Trends report, landlords are continuing to reduce borrowing as levels of gearing reached an all-time low in Q4 2017.

Average LTV of investment property portfolios was 35% in Q4 2017, the joint-lowest level recorded in over 15 years, as recent fiscal and regulatory changes targeting landlords have dampened landlord motivation to take higher LTV buy-to-let mortgages.

Meanwhile, asked at what point they would need to sell properties in the event of rising mortgage interest rates, landlords appeared confident of coping with increased outgoings, with more than half (51%) of landlords saying any decision to sell properties is not dependent on mortgage interest rate.

Of the remaining 49%, the average mortgage interest rate at which landlords said they would consider selling properties is 5%.

More than four out of ten respondents (43%) said that any decision to increase rent was not dependent on mortgage interest rates, and slightly more than half (51%) said that any decision to refinance properties was not dependent on mortgage interest rates.

John Heron, Managing Director – Mortgages at Paragon said: “Contrary to the view held by some, there is strong evidence that gearing levels across portfolios are very low in the buy-to-let sector, with a peak of 43% LTV across all types of landlords in the last 15 years. Since that peak in 2012, gearing has been on a downward trend and currently sits at an all-time low of 35%.

In response to fiscal changes over the last two years, landlords are clearly less willing to take higher loan-to-value mortgages and borrow more, whilst regulatory changes, though welcomed by lenders, have constrained the market in its ability to offer higher LTV mortgages.

There is no evidence to suggest lending to landlords has been anything other than sustainable. With low levels of gearing landlords appear well positioned to withstand the higher interest rates that the markets are anticipating, which is good news for buy-to-let and the wider private rented sector.”
